HUPPATZ.—On the 27th March, at his
late residence, Saddleworth, Friedrick
August Huppatz, aged 83 years 7 months.

HUPPATZ.- THE FRIENDS of the late Mr.
FRIEDRICK AUGUST HUPPATZ are re-
spectfully informed that his Funeral will leave
his late residence, Saddleworth, on SATURDAY,
at 3.30 p.m., for the Auburn-road Cemetery.

DISPUTE ABOUT A WILL
Before Mr. Justice Angas Parsons, in
the Civil Court yesterday, an applica-
tion was brought by Frederick Rudolph
Huppatz and Herman Homburg, as exe-
cutors of the will of the late Friedrich
August Huppatz, of Saddleworth. They
asked that probate should be granted
to the will dated January 26, 1931, and
to a codicil dated January 28, 1931.
Roma Mary Huppatz, Max Edwin
Huppatz, Kevin John Huppatz, and
Adolph Barry Huppatz claimed to be
interested (as grandchildren) in the
estate and effects, being the children
of Mary Ellen Huppatz, a daughter.
For the defence, it was alleged that
the will and codicil were not duly exe
cuted according to the provisions of
the statute, and that Huppatz, at the
time when the alleged will and codicil
were executed, was not of sound dis
posing mind, memory and understand
ing. The Court was asked to pro-
nounce against the will and codicil.
It was said that Huppatz was over 80
years, and had been ill for some time.
F. A. Huppatz, on his own behalf,
and Lily Anna Huppatz, as represen-
tatives of a number of grandchildren,
intervened.
Mr. R. Kearnan, with Mr. R. Hom
burg, appeared for the executors: Mr.
J. L. Travers for Roma Huppatz and
others of the same class; Mr. M.
Krewaldt for Friedrich August Hup
patz; and Mr. F. H. Chapman for Lily
Anna Huppatz, representing a class of
beneficiaries under the will and codicil
The hearing was adjourned until this
morning.
